PETAR LTD
These Terms & Conditions apply to all commissions and purchases placed with PETAR LTD (“we”, “us”, “our”). By placing an order, you (“the Client”, “you”, “your”) agree to the following terms.
1. The Service
1.1 PETAR LTD undertakes bespoke and couture garment commissions made to the Client’s individual measurements and agreed specifications.
1.2 “The Order” refers to the garment or garments described in the associated invoice.
1.3 By placing an Order with PETAR LTD, the Client confirms that they are at least 18 years of age and legally capable of entering into a binding contract.
2. Designs and Specifications
2.1 The agreed design, documented in writing at the time of placing the Order, forms the contractual basis of the commission.
2.2 Any variations requested after the Order is placed must be agreed in writing.
2.3 Design changes or additional work requested during the process may incur additional charges and may extend the estimated completion timeline.
2.4 The final garment may differ from any sample or illustration due to differences in size, proportion, fabric batch, or the natural characteristics of materials.
2.5 All designs, patterns and related intellectual property created by PETAR LTD remain the property of PETAR LTD unless otherwise agreed in writing.
3. Fabrics
3.1 Fabric swatches, illustrations and digital representations are provided for guidance only.
3.2 Variations in shade, weave, texture or finish may occur between sample and final fabric.
3.3 Fabric availability is subject to supplier stock. In the event of supply difficulties, suitable alternatives will be discussed with the Client.
4. Measurements
4.1 Measurements are recorded at the time the Order is placed.
4.2 Once patterns are drafted, fabric is cut, or work has commenced, significant dimensional changes may require additional work and will incur additional charges.
4.3 The Client must inform PETAR LTD prior to placing the Order of any anticipated body changes, including weight fluctuation, pregnancy, changes in undergarments, or heel height.
4.4 PETAR LTD shall not be responsible for delays, additional costs, or fit issues arising from body changes after the Order is placed.
5. Fittings
5.1 A minimum of two fittings is required for bespoke garments. Additional fittings may be necessary depending on complexity and fit requirements.
5.2 Any estimated number of fittings provided at the outset is indicative only and cannot be guaranteed.
5.3 Missed, rescheduled or delayed appointments may result in delays to completion.
6. Deposit and Payment
6.1 A non-refundable deposit is required at the time of placing the Order:
(a) 50% for couture and bespoke garments
(b) 70% for bridal commissions
6.2 Payment of the deposit confirms the Client’s instruction for PETAR LTD to secure materials and commence work.
6.3 The remaining balance is due prior to collection or dispatch of the garment.
6.4 Payments made by bank transfer must clear in full before collection or shipment.
6.5 Title in the garment remains with PETAR LTD until full payment has been received.
7. Additional Work
7.1 Any additional work requested during the process, and agreed with the Client, will be added to the final invoice.
7.2 Minor comfort adjustments do not constitute a manufacturing fault and may incur additional charges.
8. Overseas Orders
8.1 Bespoke garments require in-person fittings. For this reason, bespoke services are available only to Clients able to attend fittings in person.
8.2 Overseas Clients may order made-to-order garments in standard UK sizes only.
8.3 Full payment is required in advance for all overseas made-to-order garments.
8.4 Delivery costs will be added to the invoice unless otherwise agreed.
8.5 PETAR LTD is not responsible for customs duties, import taxes or other fees in the destination country.
8.6 Risk transfers to the Client upon dispatch. PETAR LTD is not liable for delays, loss or damage occurring during transit once the garment has been dispatched.
9. Delivery and Collection
9.1 Delivery is not included unless expressly stated in writing.
9.2 Risk transfers to the Client upon collection or dispatch.
9.3 The balance must be paid in full before the garment is released.
10. Cancellation
10.1 If the Client cancels the Order after work has commenced or fabrics have been ordered, the deposit will not be refunded.
10.2 If cancellation occurs after substantial work has been completed, PETAR LTD reserves the right to charge a proportion of the remaining balance reflecting work undertaken.
10.3 If the garment is complete or nearly complete at the time of cancellation, the full balance shall be payable.
10.4 If PETAR LTD cancels the Order due to circumstances beyond its reasonable control, any deposit paid will be refunded in full. No further liability shall arise.
11. Time of Completion
11.1 Any estimated completion date is provided as guidance only.
11.2 The making process for bespoke garments typically takes approximately six to eight weeks from the date of confirmed Order and deposit. This timeframe is indicative only and may vary depending on complexity, fabric availability, fitting schedule, or other factors beyond our reasonable control.
11.3 PETAR LTD cannot guarantee completion by a specific date.
11.4 PETAR LTD shall not be responsible for delays caused by:
• Client-requested changes
• Missed or rescheduled appointments
• Supplier delays
• Industrial action or strikes
• Shipping or customs delays
• Events beyond our reasonable control
11.5 Clients commissioning garments for fixed events are advised to allow sufficient time for unforeseen circumstances.
11.6 For bridal commissions, the Client is responsible for ensuring that the Order is placed with sufficient time prior to the event date. PETAR LTD shall not be liable for losses arising from late orders, Client delays, or circumstances beyond our reasonable control.
12. Completion and Acceptance
12.1 Collection and final fitting of the garment constitutes confirmation that the Client is satisfied with the fit, finish and agreed specification. No further liability shall arise once the garment has been accepted.
12.2 If a garment is collected without being tried on, subsequent alterations that could reasonably have been addressed at collection may incur additional charges.
13. Returns
13.1 All bespoke and made-to-order garments are produced to the Client’s individual specifications.
13.2 Returns and refunds are not available unless there is a demonstrable manufacturing fault.
13.3 This does not affect the Client’s statutory rights under UK law.
14. Force Majeure
14.1 PETAR LTD shall not be liable for failure or delay in performing its obligations where such delay results from events beyond its reasonable control, including but not limited to supplier shortages, transport disruption, industrial action, natural events, or governmental restrictions.
15. Statutory Rights
15.1 Nothing in these Terms & Conditions affects the Client’s statutory rights under applicable UK law.
